Planning Commission Members Present:  Kathryn Brown, Don Nickless, and Thor Konwin.  Others Present:  Bruce Payntor, Anita Payntor, Tom Carrara, Amy Loomis, and Kelly Giard - Recording Secretary.


D. Nickless, Chair, called the meeting to order at 7:03 PM to reconvene the Payntor Subdivision Application discussion.


Subdivision Request


Mr. Payntor submitted maps indicating the Right of Way and septic design for the property in which there is an application for a subdivision.  Mr. Payntor stated that the septic was over designed for an accessory apartment.  Mr. Payntor explained that the design presented was for a handicap, 2-bedroom house.  Mr. Payntor also explained that he currently has an application in process for a small mobile home on the same lot that he is seeking a subdivision.  Mr. Payntor stated that the barn on the property will be used as a storage facility for lawn care equipment and not a dwelling.  D. Nickless indicated to Mr. Payntor that the sewer plans are not applicable to the Planning Commission.


D. Nickless stated that the map shows a 16' "strip" and asked Mr. Payntor to explain.  Mr. Payntor explained that there is a curb cut to "lot 1" and the access to "lot 2" would use this strip and there would be a right of way via easement to the parking access to this lot. 


Motion by D. Nickless and seconded by T. Konwin to enter into Deliberative Session at 7:08 PM.  Passed unanimously.


The Planning Commission came out of Deliberative Session at 7:37 PM.


Motion by T. Konwin and seconded by K. Brown to defer the subdivision request to the Zoning Administrator who will issue a decision within a timely manner.  Passed unanimously.  Mr. Payntor asked for clarification and A. Loomis indicated that she has 45 days to issue a decision. 


Flood Hazard Area Regulations


D. Nickless stated that he has spoken with Linda Drummond regarding the letter that will be sent to the property owners within the list from the Rutland Regional Planning Commission regarding the flood plane.  Ms. Drummond will be on vacation and will work on this project when she returns.  D. Nickless stated that the list that was presented from the RRPC has only physical addresses and the property owners will need to be matched up with the addresses. 


There was discussion regarding the contact person that is mentioned within the letter.  A. Loomis will be the contact at the Town Office. 


There was discussion regarding the map.  Currently, the map is "tentative" and D. Nickless has a copy of this map.  A. Loomis stated that the FEMA maps are the maps that are referred to in the letters and not a town/local map.


Other Business


A. Loomis stated that she currently has 2 applications that she will be bringing before the Planning Commission prior to her approval due to the zones these properties are located.  One is an expansion within a Rural/Commercial District and the other is for a home occupation in the Village.


D. Nickless discussed a letter that was sent to the Select board in regard to the Rowe Gravel Pit expansion. 


D. Nickless is hoping to get the information from the RRPC on the Town Plan.  There was discussion of resuming the meetings with the local groups.  There is a possibility of asking the Lothrop PTO to the May 8 meeting.  Anita Payntor has the contact information for this group.


The next meeting will be held on May 8, 2008.
