Meeting Minutes : Special Select Board – 11/6/19

Members Present – Thomas Hooker, Thomas “Hank” Pelkey, David Mills, Alicia Malay (4:03 PM) and W. Joseph Gagnon. Others Present: Linda Trask, Bill Drummond, Donna Wilson, Nicholas Michael, Carl Andeer, Lisa Wright (4:20 PM), Town Manager John Haverstock, Kelly Giard – Recording Secretary.

The meeting was called to order at 4:00 PM by Chairman Hooker.

J. Haverstock reported that there was no need to enter into Executive Session.

J. Haverstock stated that there was no need to amend the agenda. Motion by D. Mills and seconded by T. Pelkey to accept the agenda as posted. Motion passed unanimously 4 – 0 (Malay absent).

Discussion of Options Regarding the Future of the Assessment Function and the Listers’ Office:

J. Haverstock gave the history of the Listers’ Office, which includes the retention of an Independent Consultant who has history in Pittsford, as well as the retention of a former Lister, who is also a consultant.

Carl Andeer, an attorney with the Vermont League of Cities and Towns (VLCT), was contacted and was present at this meeting to discuss the Town’s options regarding the function within Pittsford.

Mr. Andeer explained that the Select Board can hire assistance for the Listers’ Office to complete the necessary workload or appoint a resident to fill vacant positions until the next Town Meeting, due to this being an elected position; the Select Board can eliminate the office and hire an Assessor; the Select Board can adopt a Governance Charter, which would need to be brought before the State Legislature for approval.

Mr. Andeer presented a PowerPoint presentation that discussed all of the options.

Mr. Andeer explained that the elimination of the Listers’ Office would require a town vote at Town Meeting. The Vermont law states that there must be a paper ballot vote, and not an Australian Ballot. The paper vote must occur on the floor of Town Meeting. The Select Board then hires a single person to assume the previous responsibility of 3 people. Mr. Andeer explained that If there were Listers currently in the position when the office is eliminated, their term would expire 45 days following the vote. If the Town whishes to have both an appointed assessor and one or more Listers, there must be a Charter approved by residents in a town-wide vote and by the State legislature.

Following the presentation, Mr. Andeer had discussion with the current Listers’ Office Staff and was able to provide helpful website information for the members of the Select Board and the Listers’ Office Staff to assist with any questions or concerns. Mr. Andeer also invited those in attendance to contact him with any questions or concerns.

Listers’ Errors and Omissions (Parcels 1392 & 1079):

Lisa Wright and Nicholas Michael presented a request to the Select Board for an error on Parcel 1392, which is located on Arch Street. The property was purchased in March 2019. The new owner was sent the information regarding the change of appraisal/grievance notice. The property owner did not submit a grievance by the deadline. Motion by T. Pelkey and seconded by D. Mills to deny the request to lower the property value. Motion passed unanimously 5 – 0.

Parcel 1079 was transferred prior to April 1, 2019 and was not recorded as such. Motion by D. Mills and seconded by A. Malay to approve the request. Motion passed unanimously 5 – 0.

A memo was read as an FYI with regard to the David and Victoria Fish property on Markowski Road. The Select Board will be advised if action is necessary on this parcel.
