1. Call to order
The meeting was called to order at 7:01PM by Dave Mills – Chair.
2. Approval of Agenda
A motion was made by David Soulia and seconded by Mark Winslow to approve the agenda, as amended. The motion passed unanimously.
Add Item 5 – Discuss Hearing for the Giddings Site Plan

4. Discuss Town Attorney’s Suggestions to Zoning Ordinance
Dave Mills advised that Rick Conway had some concerns with the quarrying noted in the Uses and met with Gary Kupferer, the Town’s attorney, and provided Mr. Kupferer a copy of the proposed changes to the Zoning document. There is a notation for Earth Resources Extraction/Quarry and later in the document it indicates just Quarrying. Mr. Kupferer’s recommendation is to remove the word “Quarrying” and use Earth Resources Extraction only. In Rural and Commercial, this would be conditional and would be permitted in Industrial.
On Page 13, Mark Winslow noted under the Table of Uses the “c” should have been in Rural not Village and should be corrected.
On Page 4 Section 201, it should state five districts, not six. At the last meeting, it was suggested to include Manufacturing in the Commercial section. Mr. Kupferer recommended the change not be made until there is a good definition for manufacturing.
Rick Conway asked if the map has been corrected in the Table of Content and Dave Mills confirmed this was corrected. Mr. Mills noted Rural Commercial was removed from the most current draft.
A motion was made by Mark Winslow and seconded by David Soulia to approve the changes as recommended by the Town’s attorney and to correct the typo under the Table of Uses moving Quarrying from Village to Rural. The motion passed unanimously.
A motion was made by Kevin Blow and seconded by Mark Winslow to approve the Zoning document, as amended. The motion passed with one “No” vote – Ted Gillen.
David Soulia will provide the Zoning Administrator the updated draft for distribution next week. The document will be sent in accordance with Title 24, Section 441. It was noted the Town is allowed to send the document electronically, as long as there is proof of receipt. The Zoning Administrator will be requested to distribute the document electronically and request proof of receipt. For any interested party that has not provided proof or receipt, the Zoning Administrator will mail the document by certified mail.
5. Discuss Hearing for the Giddings Site Plan
Dave Mills advised the Zoning Administrator would like to place this item on the same agenda as the Zoning ordinance hearing. Mr. Mills suggested the Giddings hearing could be held just prior to the Zoning ordinance hearing on December 13th. Mr. Mills noted the documentation appears to be professionally done and should be self-explanatory. Rick Conway confirmed the documentation has been done by a professional and the Zoning Administrator is comfortable with the package. Mr. Mills advised the Zoning ordinance hearing is scheduled to be held at the Town Office. It was the consensus of the Planning Commission to schedule the Giddings Site Plan hearing for 6:00PM on December 13th, prior to the Zoning hearing scheduled for 7:00PM. Mr. Conway suggested the Zoning Administrator distribute the information for the hearings to the Planning Commission members as soon as possible.

A motion was made by Mark Winslow and seconded by David Soulia to adjourn the meeting at 7:19PM. The motion passed unanimously.
