Zoning Board of Adjustment Members Present – Stanley Markowski – Chairman, Rick Conway – Vice Chairman, Ed Keith, Jr., Clarence Greeno, Dan Adams and Jack Orvis.  ABSENT:  Nicholas Michael.

Others Present – Atty Jack Facey, Jeff Biasuzzi – Zoning Administrator and Kelly Giard – Recording Secretary

S. Markowski, Chairman, called the Zoning Board of Adjustment to order at 7:00 PM.  S. Markowski explained that this was the continuation of the Public Hearing of September 11, 2017.

Motion by C. Greeno and seconded by E. Keith to approve the agenda as presented.  Motion passed unanimously 6 – 0.

Motion by C. Greeno and seconded by R. Conway to approve the minutes of the September 11, 2017 meeting.  Motion passed 5 – 0 – 1 (Adams).  J. Biasuzzi asked for clarification of the Keith hearing, which was explained as not necessary; clarification for the Spensley application was also sought, which was explained as being approved with no conditions.

There was no Public Comment presented.

Motion by R. Conway and seconded by C. Greeno to enter into Deliberative Session with Atty Facey.  Motion passed unanimously 6 – 0.

J. Biasuzzi was invited to enter Deliberative Session at 7:20 PM.

The Zoning Board of Adjustment exited Deliberative Session at 7:50 PM.

S. Markowski explained that there was no harm done with regard to the publication due to the limited days of publication.  Atty Facey read from the Statute 4464 Section A5 for clarification.  J. Biasuzzi has agreed to have the notices out in a more timely manner.  J Biasuzzi stated that there was a typographical error in the Public Notice that was in the Rutland Herald with regard to the Planning Commission Public Hearing.  Atty Facey stated that a corrected ad should be run to avoid any issues.

J. Biasuzzi was instructed to draft the Findings of Fact for the Spensley and Keith hearings.

Motion by C. Greeno and seconded by J. Orvis to approve the Wilbur application withdrawl.  Motion passed unanimously 6 – 0.

Atty Facey will be in communication with Mr. Gallus regarding his concerns with the Kennedy permit.

Motion by R. Conway and seconded by C. Greeno to consult with an attorney with regard to the application.

Motion by R. Conway and seconded by D. Adams to adjourn at 8:00 PM.  Motion passed unanimously 6 – 0.
