1. Call to order

The meeting was called to order at 5:00PM by Don Nickless – Chair.

b. New Business

1) Application for subdivision submitted by Daniel Adams, property owner, for property located at 1405 Vermont Route 3, Parcel ID #1645, in the town of Pittsford, Vermont. Proposal to subdivide parcel of land currently consisting of 40 acres into two (2) parcels being +/-3.5 acres for Lot 1 and +/- 36.5 acres for Lot 2

Don Nickless requested clarification of the proposed subdivision. Daniel Adams advised there is a 3.5 acre parcel that will be subdivided out and the remainder of the 40-acre parcel surrounds this subdivision. The access will be from Corn Hill Road for the larger parcel because access is not feasible from Route 3. Mr. Adams owns the Smith lot and the right of way will go across that property. Mr. Adams provided a copy of the driveway permit to the Planning Commission. There are two existing structures that include a garage and a house on the smaller parcel. There is a curb cut to the current house from Route 3 and the garage is an active repair shop. Mr. Adams stated this parcel was bought 25 years after he had purchased the Hathaway parcel and was purchased about two years ago. Mr. Nickless questioned whether the parcels have been surveyed. Mr. Adams reported the parcels have not been officially surveyed, but the lines have been corner pinned with a GPS by the Jim Purdy, the geologist who is doing the state subdivision for the septic system. In the opinion of the applicant, it is felt that the lines are accurate with the GPS. The 36-acre parcel will be coming off Corn Hill Road and the smaller parcel already has access from Route 3. There are no issues with water or septic and the permit is in the pipeline to be signed. There are currently no structures on the 36 acres. It is noted on the map where the proposed building site will be. The building permit application has been filed and shows the house site and the access. Don Nickless stated there would not be any current issues with the subdivision, however, in the past when dividing lots; there have been some issues with parcels that have not been surveyed. Mr. Adams stated all of the abutting landowners are surveyed on their sides and also noted he owns the land around most of the parcel. Mr. Adams stated currently there is a tenant in the house and it is his intent to just subdivide at this point, with the possibility of selling in the future. When he goes to sell the property in the future, he will have it surveyed, but as of now the occupant is his tenant. Mr. Adams stated the monuments are placed and well-marked with wooden stakes. Don Nickless stated the Planning Commission has been asking for surveys to avoid future issues with boundary lines and expressed his concern with the use of a GPS and not a formal survey. The Zoning Administrator recommended the stakes be replaced with iron pins as they would be less likely to be removed. Ms. Lewis also expressed the same concern of issues that could take place in the future if the parcel is not surveyed.

A motion was made by Don Nickless and seconded by Trish Lewis to approve the subdivision as submitted. The motion passed unanimously.

6. Other Business

Ken Niemczyk reported that information on an amended Open Meeting Law has been received. As of July 1, 2014, the meeting minutes have to be posted on the web site and made available in five calendar days from the date of the meeting. Mr. Niemczyk suggested producing the minutes in the five days and as part of the task, indicate DRAFT on the minutes submitted. It was also suggested the Recording Secretary could email the minutes to the Zoning Administrator within the required time to assure that they are posted on the website in draft form. The Planning Commission will review the minutes, provide corrections and a final version of the minutes will be posted on the website once they are approved at the subsequent Planning Commission meeting.

With regard to the zoning regulations update, Don Nickless will write a cover letter to be included in the mailing to the state and the abutting communities. A final hearing will be scheduled for public comment to the proposed changes. Trish Lewis will review and provide a final draft document to the Planning Commission for review. The mailing will provide the new language highlighted and a draftwith the old language will be available upon request.

The Zoning Administrator recommended recruiting for the two open positions on the Planning Commission.

July 24, 2014 @ 7:00PM at the Pittsford Town Office.

A motion was made by Trish Lewis and seconded by Kathryn Brown to adjourn the Pittsford Planning Commission meeting at5:39PM. The motion passed unanimously.
