Meeting Minutes : Zoning Board of Adjustment

Zoning Board of Adjustment Members Present – Stanley Markowski – Chairman, Rick Conway – Vice Chairman, Clarence Greeno, Jack Orvis and John Mitchell.

Others Present – Atty. Gary Kupferer, Vincent Gatti, Ken Niemczyk – Zoning Administrator, and Kelly Giard – Recording Secretary.

S. Markowski, Chairman, called the Zoning Board of Adjustment to order at 7:00 PM. S. Markowski introduced the members of the Zoning Board of Adjustment.

S. Markowski explained that this was an application for a Conditional Use presented by the Proctor-Pittsford Country Club to install a bar area open to the public at property located at 311 Country Club Road, Parcel ID #1116. The permit was posted in the required three (3) public places on February 24, 2014; published in the Rutland Herald on February 26, 2014; and posted on the Town website on February 24th.

S. Markowski swore in Vincent Gatti – 90 Olympus Road – Proctor, VT – employed by General Electric. Also swore in Ken Niemczyk, Zoning Administrator.

K. Niemczyk explained the application as a request for physical work to be constructed within the current building. The current dining room has bar service and will be adding additional service and open to the public. C. Greeno indicated that the Country Club is currently open to the public for service.

Mr. Gatti explained that the bar is currently 10’ wide and they are looking to add another 10’ and make the bar a ‘U’ shape. Mr. Gatti explained that there will be nothing changing with relation to the service and the project is an inside project.

R. Conway inquired if there was a current Liquor License. Mr. Gatti indicated that there was currently a Liquor License and there was no change.

Atty. Kupferer inquired if the lunch service, bar service and golf service were currently open to the public. Mr. Gatti answered in the affirmative and indicated that the hours would not change as the service is contracted to an outside contractor. Atty. Kupferer inquired who was the holder of the Liquor License. Mr. Gatti explained that the contractor was the holder of the license.

Atty. Kupferer confirmed with K. Niemczyk if the permit was for internal renovations and if there was a permit required for such a project, to which Mr. Niemczyk stated that no permit was required within the Town of Pittsford for an internal renovation project.

J. Mitchell stated that since no permit was necessary that the permit fees should be returned to the Country Club. The members of the Zoning Board of Adjustment agreed.
Motion by R. Conway and seconded by C. Greeno that the application does not require a permit and that to return the fees paid for the permit. Motion passed unanimously 5 – 0.

Motion by C. Greeno and seconded by R. Conway to adjourn at 7:15 PM. Motion passed unanimously 5 – 0.
