Pittsford Planning Commission Meeting    

January 23, 2014

               

Board Members Present: Kathryn Brown, Trish Lewis, Chris Beitzel

 

Board Members Absent:  Don Nickless

 

Also in Attendance:Ken Niemczyk – Zoning Administrator, Beverley Taranovich, Carmella Regina Carter, Maggie Meyer, Steve Mitowski, Stephanie Elnicki

 

1.  Call to order

 

The meeting was called to order at 7:00PM by Trish Lewis, Vice-Chair.      

    

2.  Administrative Matters

 

Trish Lewis stated with the resignation of Mike Gecha, any motions put on the table have to be passed with a majority of the total board membership.  With the absence of Don Nickless this evening, any motions on the table during this meeting would require all members to agree for them to pass.

 

3.  Public Hearings

 

The hearing was opened at 7:01PM.

 

a) Old Business

 

(1) Consideration to suspend review of proposed changes to the Zoning Map for the Town of Pittsford

 

Trish Lewis stated her position on this matter is to suspend any activity on the zoning map at this time and work on cleaning up the zoning regulations.

 

A motion was made by Trish Lewis and seconded by Chris Beitzel to suspend the review of the proposed changes to the zoning map.  The motion passed unanimously.

 

b) New Business

 

1. Application for Subdivision Review submitted by Beverley Taranovich, property owner, for property located at 84 Deere Road (Florence), Parcel ID #1859, in the Town of Pittsford, Vermont.  Proposal to subdivide parcel of land currently consisting of 10.06 acres into two (2) parcels being +4.03 acres for Lot 1 and +6.03 acres for Lot 2.

 

Beverley Taranovich requested to subdivide the commercial T & T building from the house that was built in 1989. Ms. Taranovich outlined the subdivision request on the map provided to the Planning Commission. The property is currently 10.06 acres. Ms. Taranovich stated when they subdivided the property from the barn in the 1970’s; there was a requirement that it had to be 10 acres for a commercial property.  There is no longer that type of requirement for commercial property. The property has a right of way for the Town of Proctor to access their landfill and this will remain. Trish Lewis stated it needs to be determined what the original piece of land was and what the acreage will be for the two lots once subdivide. Ken Niemczyk stated the two pieces would equal 10.06 acres and would be subdivided into Lot 1 with 4.21 acres and Lot 2 would be 5.85 acres with the house, the easement and the gate on it. Currently the house is occupied by renters. Trish Lewis asked if any of the public wished to speak and there were no additional comments.

 

A motion was made by Chris Beitzel and seconded by Kathryn Brown to approve the subdivision application submitted by Beverley Taranovich, as presented. The motion passed unanimously.

 

The hearing was closed at 7:16PM.

 

2. Application for Subdivision submitted by Carmella Carter, property owner, for property located at 4875 Route 7 North, Parcel ID #1130, in the Town of Pittsford, Vermont.  Proposal to subdivide parcel of land currently consisting of 106 acres into two (2) parcels being +5.0 acres for Lot 1and +101 acres for Lot 2.

 

The hearing was opened at 7:17PM.

 

Maggie Meyer was present and spoke for Carmella Carter who was also present for the hearing. An additional geology map was provided to the Planning Commission. This property has a total of 106 acres with frontage on Kendall Hill and Route 7. The request is to subdivide 5.5 acres with the frontage on Kendall Hill behind the tree line.  The property is currently cornfields and will have a 50 foot right of way frontage on Kendall Hill to gain access to the rear property. The subdivision will be two lots with Lot 1 being 101 acres and Lot 2 will be 5.5 acres. The reason for the subdivision is that a solar company will be purchasing the 5.5 acres and the sale is subject to getting the subdivision. The road frontage will stay with the original lot. Trish Lewis asked if a new curb cut would be created and it was noted it would not.  Ms. Meyers stated a culvert would have to be installed if the company goes through with the project. Ms. Meyers provided a copy of the Application for Access/Right of Way Permit and she noted that they have had a discussion with Shawn Erickson. Chris Beitzel asked how large the solar project will be.  Ms. Meyers stated it is standard with what the state will approve. Trish Lewis suggested planting clover around the solar panels would provide a productive land for the wildlife around the area and would be environmentally conscientious. Trish Lewis asked if any of the public wished to speak and there were no additional comments. Ms. Lewis reported that she had received a call concerning this application. The party was not concerned with the subdivision, but was concerned with the company purchasing the property, and there was a question of whether it was for windmills. Ms. Meyers advised the proposed use is not for windmills.   

 

A motion was made by Chris Beitzel and seconded by Kathryn Brown to approve the subdivision application submitted by Carmella Carter, as presented. The motion passed unanimously.

 

The hearing was closed at 7:28PM.

A motion was made by Chris Beitzel and seconded by Kathryn Brown to adjourn the Pittsford Planning Commission meeting at 7:31PM. The motion passed unanimously.
