TOWN OF PITTSFORD

PLANNING COMMISSION

July 19, 2012

 

Planning Commission Members Present – Don Nickless, Trish Lewis, Mike Gecha and Thor Konwin.   Others Present – Bev Peterson, Kathryn Parker, Donald Parker, Christine Halliday, Matt Halliday, Patrick Maher, Dorothy Parkinson, Ferne Faivre, Rick Colburn, Ann Radamacher, and Ken Niemczyk – Zoning Administrator.

 

D. Nickless, Chair, called the meeting to order at 7:00 PM.

 

PUBLIC HEARINGS:

 

1.  Application by Raymond H. Page, agent for Richard W. Colburn for property located at 2051 Corn Hill Road, Parcel ID # 1663 for a subdivision of 41.4 acres into 2 lots (29.4 acres and 12.00 acres).

 

K. Niemczyk indicated that the easement meets criteria.

 

T. Konwin inquired if the set-backs were met.  K. Niemczyk indicated that the set-backs are met.  T. Lewis inquired if the adjoining property owners were notified.  K. Niemczyk indicated that the proper notices and notifications were completed.

 

Mr. Halliday, an adjoining property owner to the south inquired if the Zoning Regulations section 103 would be taken into consideration.  D. Nickless indicated that that section would be considered in the permitting process, in the event of construction on the piece of property.

 

Mr. Halliday indicated that the survey is not the same as his as being off by 15°.  Mr. Halliday explained that 15° is equal to 85’.  Mr. Halliday has been in contact with Mr. Page, who indicated that this difference is in the magnetic north vs. true north.  Mr. Halliday explained that the property was originally surveyed in 2004 with the pin placement at the fence line.

 

D. Nickless inquired if there was an agreement between the deed and the surveyor’s drawing.  Mr. Halliday indicated that his deed and survey agree, however, does not agree with Mr. Colburn’s survey.

 

D. Nickless recommended that the Halliday’s, Colburn’s and Mr. Page compare deeds and surveys and reconcile any contradictions between the deeds and surveys such that there is agreement on the property boundary.  The subdivision request can then be considered.

 

Motion by D, Nickless and seconded by T. Konwin to recess the hearing until the July 26, 2012 meeting.  Motion passed unanimously 4 – 0.

C. Halliday, M. Halliday, P. Maher, and R. Colburn exited at 7:26 PM.

 

  1. Application by Robert C. Forrest for property located at Allen Mills Road, Parcel ID # 0437 for a subdivision of 265 acres into 2 lots (±227 acres and 38.2 acres).

 

There was no representation present to discuss the proposal.

 

Motion by D. Nickless and seconded by T. Konwin to adjourn the hearing until the August 23, 2012 meeting.  Motion passed unanimously 4 – 0.

 

 

PUBLIC COMMENT:

Ann Radamacher inquired about the Rutland Regional Planning Commission update that was presented by Trish Lewis at the Select Board meeting and requested that the Regional Planning Commission discuss the proposed wind project.  T. Lewis indicated that the Region has found this topic premature to discuss until a permit for the project has been filed with the state as the Region has very strict guidelines on what they can act upon.

 

Bev Peterson read a recommendation from Carol Geary from North Clarendon requesting a moratorium on the wind tower project, and currently, there are 9 out of 27 towns that are planning on banning commercial wind generation.

 

Dorothy Parkinson inquired if there was an increase in the membership of the Planning Commission.  D. Nickless indicated that Mike Gecha and Chris Bietzel have been appointed by the Select Board to the Planning Commission.

 

Ms. Parkinson indicated that Reunion Power has indicated that there would be an application filed in August and requested that Pittsford should update and amend the Town Plan soon.  There was discussion concerning the public hearings and guidelines that need to be adhered to before any amendments can occur.  D. Nickless also explained that there are groups within town that are working on proposals for the Town Plan amendments and that the Planning Commission has been “short staffed” and have been very busy working on the Zoning Regulations, which expire in December.  The Zoning Regulations are currently in the “Interim” status, therefore, require attention.

 

OTHER BUSINESS:

 

The Planning Commission members continued discussions on updating the Zoning Regulations.

 

ADJOURNMENT:

 

The Planning Commission adjourned at 8:41 PM.

 

The next meeting will be held on July 26, 2012 at 7:00 PM.
