PLANNING COMMISSION
April 26, 2012
Planning Commission Members Present – Don Nickless, Trish Lewis, and Thor Konwin. Others Present – Bev Peterson, Vanessa Mills-Holmquist, Kathryn Parker, Donald Parker, Allen Mills, Roberta Mills, Robert Schoen, Tom Loyzelle, Lisa Wright-Garcia, Ken Niemczyk – Zoning Administrator, and Kelly Giard, Recording Secretary
D. Nickless, Chair, called the meeting to order at 7:00 PM.
PUBLIC HEARINGS:
1. Application by Robert H. and Marjorie E. Schoen for property located at 120 Adams Road, Parcel ID# 1452 for a subdivision of 11.39 acres into 2 lots (10.2 acres and 1.19 acres).
T. Konwin inquired the purpose of the 1.19-acre lot. Mr. Schoen indicated that his current house is on the market and under contract and he would possibly build a smaller home on the smaller lot.
K. Niemczyk inquired if there has been any soil testing or proposed septic system locations. Mr. Schoen indicated that only mound systems are being approved by the State and has spoken with the State concerning this and also indicated that there have been no well issues on that side of the road.
D. Nickless indicated that there had been boundary line concerns at previous Planning Commission meetings. Mr. Schoen indicated that he has had the property surveyed and there are currently pins in place with orange tape.
D. Nickless inquired the amount of frontage. Mr. Schoen indicated that there is 74.2’ of frontage on one parcel and 27.39’ on the other parcel, giving a combined 101.6’ of frontage for the new proposed lot. K. Niemczyk indicated that the frontage is adequate.
Following discussion concerning the septic issues, the Planning Commission members agreed to discuss this request in Deliberative Session.
Mr. Schoen exited at 7:23 PM.
2. Application by Thomas D. Loyzelle for property located at 35 Chittenden Road, Parcel ID # 0819 for a subdivision of 5.47 acres into 2 lots (2.1 acres and 3.37 acres).
Mr. Loyzelle explained the survey maps that were presented and explained that the survey has been completed and the septic is being designed by a civil engineer.
D. Nickless inquired the driveway right of way. Mr. Loyzelle explained the property layout and indicated that a small home was going to be constructed on the second parcel, however, there is no intention of selling either parcel at this time.
Mr. Loyzelle indicated that the septic system drawings have been submitted to the State; however, the abutters were not notified of the Planning Commission meeting. Mr. Loyzelle indicated that he would contact the abutters of the next meeting. Mr. Loyzelle indicated that he would not be starting any construction or work until all state and town permits and approvals are in place.
Motion by D. Nickless and seconded by T. Lewis to recess the meeting until May 17, 2012 at 7:00 PM. Motion passed unanimously.
PUBLIC COMMENT:
Several residents were present to discuss the Town Plan and their opposition to the proposed wind farm project.
K. Niemczyk explained that the State makes the ultimate decision and the Town has no authority in the decision. Residents were encouraged to attend any and all State hearings concerning this project.
Following discussions, the residents exited at 8:09 PM.
DELIBERATIVE SESSION:
Motion by D. Nickless and seconded by T. Konwin to enter into Deliberative Session to discuss the Schoen subdivision. Motion passed unanimously 3 – 0.
The Planning Commission entered Deliberative Session at 8:10 PM.
The Planning Commission exited Deliberative Session at 8:25 PM.
Motion by D, Nickless and seconded by T. Konwin to approve the Schoen subdivision as presented. Motion passed unanimously 3 – 0.
OTHER BUSINESS:
The Planning Commission members continued discussions on updating the Zoning Regulations.
ADJOURNMENT:
The Planning Commission adjourned at 9:15 PM.
The next meeting will be held on May 17, 2012 at 7:00 PM.
