Meeting Minutes : Planning Commission

Planning Commission Members Present – Kathryn Brown, Don Nickless, and Thor Konwin.  Others Present – Bruce Paynter, Chris Clark, Travis Bovey, Amy Loomis – Zoning Administrator, and Kelly Giard, Recording Secretary

D. Nickless, Chair, called the meeting to order at 7:07 PM.

Site Plan Hearing:

Applicant:  Travis Bovey/Boondock Motors – 670 Hollister Quarry Road – Pittsford, VT.  Mr. Bovey is re-locating the business from 3289 West Creek Road.

D. Nickless inquired if the application was complete.  A. Loomis indicated that the application was complete.  Mr. Bovey had included a business plan, the hours of operation as being 8 AM – 5 PM (6 PM at the latest) Monday through Friday (occasionally a Saturday, which will be mainly for clean-up and not public hours); the number of employees as being 2.   Mr. Bovey indicated that the only change from the West Creek Road location would be to increase the number of vehicles in the garage to 2.

D. Nickless inquired if the business involves brakes, exhaust, suspension, new tires and batteries.  Mr. Bovey agreed and stated that the business is an authorized Interstate Battery dealer.

D. Nickless explained that the previous location had ventilation issues with painting of vehicles.  Mr. Clark explained that the painting has been “phased out” and replaced by towing vehicles.

K. Brown inquired if the business was an AAA affiliate.  Mr. Bovey indicated that there are eventual plans for AAA, however, the insurance premiums have high requirements.

K. Brown inquired if there was a pneumatic lift installed.  Mr. Bovey indicated that the lift has just arrived.

D. Nickless inquired the size of the structure.  Mr. Bovey indicated that the garage is roughly 50’ X 30’, located on 3.7 acres.  The house on the property is close in proximity.

D. Nickless inquired if an Act 250 application was required.  Mr. Bovey indicated that less than 1 acre is being used for the work area and the parking area.  Mr. Bovey indicated that there is roughly 2 acres used for pasturing animals.  Mr. Bovey indicated that roughly ¾ of an acre is being used for the business, including the garage and the parking area.

K. Brown inquired if the barn on the property is being used.  Mr. Bovey indicated that the barn is being used for personal storage.  K. Brown inquired where the parking area is located.  Mr. Clark indicated that the parking is located on the side of the garage.  Mr. Bovey indicated that the vehicles do not stay on the property.

K. Brown inquired if there are any visible neighbors.  Mr. Bovey indicated that he can see Mr. Cecot’s barn and not his house.  Mr. Clark indicated that Mr. Cecot may be able to see the side of the garage that has no parking or vehicles.

D. Nickless inquired if Mr. Bovey has been in contact with the neighbors.  Mr. Bovey indicated that he has had discussion with Mr. Cecot.

D. Nickless inquired if there are plans of signage.  Mr. Bovey indicated that a sign is unknown, depending on the process.  D. Nickless explained the procedures and recommended that Mr. Bovey be in contact with A. Loomis for direction and applications.  Mr. Clark inquired if the sign was limited to the Bovey property.  A. Loomis indicated that she would need to research the possibility of a sign and explained that the property owner’s signature is required.  Mr. Clark indicated that he has been in communication with a neighbor regarding signs.

D. Nickless inquired if there would be any outside lighting installed.  Mr. Bovey indicated that there would be no additional lighting and there are flood lights installed now.  Mr. Bovey indicated that the current lights have been in place since the building was built roughly 15 years ago.

D. Nickless inquired if there were any water facilities.  Mr. Bovey indicated that there is a restroom in the house and there is running water/sink in the shop.  K. Brown inquired if there was a flushing station in the shop.  Mr. Clark indicated that there is a flushing station in the shop.

D. Nickless inquired if there was any outside storage.  Mr. Bovey indicated that there would be vehicles outside and the parts are returned to the scrap yard a couple of times a month.  The tires are removed regularly as well.

T. Konwin inquired how the oil and fluids were disposed of.  Mr. Bovey indicated that Markowski Excavating uses these fluids in their waste burner.

D. Nickless inquired if there would be “clunkers” on the property.  Mr. Clark indicated that all vehicles would be registered.  Mr. Bovey indicated that there may be an occasional “project” car for restoration.  D. Nickless expressed concern that there not be a “junk yard”.

D. Nickless inquired how many vehicles would be on-site.  Mr. Clark indicated that there would be 3 – 10 per day.  Mr. Bovey indicated that 10 would be the maximum number.

D. Nickless inquired if the “project cars” would be unregistered.  Mr. Bovey indicated that these types of vehicles would be under cover.

D. Nickless inquired if there would be work performed outside.  Mr. Bovey indicated that work would be performed inside.

D. Nickless confirmed that the number of employees would be 2.

D. Nickless inquired if there would be any additional noise, odor, or burning of oil.  Mr. Clark indicated that the garage is heated by wood.

D. Nickless inquired if there would be any sales of vehicles.  Mr. Bovey indicated that there would be no vehicle sales.
D. Nickless inquired if there had been any contact with the State for any permits needed.  Mr. Bovey indicated that the DMV permits are in place and has been in contact with other State entities.

A. Loomis indicated that there is no need for a site visit.

Motion by D. Nickless and seconded by K. Brown to close the hearing and enter into Deliberative Session at 7:26 PM.

The meeting reconvened at 7:42 PM.

Motion by D. Nickless and seconded by T. Konwin to approve the application from Travis Bovey to operate a vehicle repair business on Hollister Quarry Road with conditions.  Passed unanimously 3 – 0.

The next meeting will be held on October 22, 2009 at 7:00 PM.
